1. Acceptance of Terms

These Terms of Use constitute a legally binding agreement between you and Bycezae governing your access to and use of the website located at bycezae.com and all associated services, features, content, and functionality offered by Bycezae (collectively, the "Services"). Your continued use of the Services following any changes to these terms constitutes acceptance of those changes.

2. Eligibility

You must be at least 18 years of age to use our Services. By agreeing to these terms, you represent and warrant that you meet this requirement. If you are using the Services on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms.

3. Account Registration

3.1 Account Creation

To access certain features of the Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@bycezae.com of any unauthorised use of your account. Bycezae will not be liable for any loss or damage arising from your failure to protect your account credentials.

3.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion, without prior notice, if we reasonably believe you have violated these terms or engaged in conduct harmful to other users, third parties, or our Services.

4. Use of Services

4.1 Permitted Use

You may use the Services solely for lawful purposes and in accordance with these terms. The Services are intended for personal, non-commercial educational use unless otherwise expressly agreed in writing with Bycezae.

4.2 Prohibited Conduct

You agree not to:

• Use the Services in any way that violates applicable laws or regulations
• Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services without express written permission from Bycezae
• Attempt to gain unauthorised access to any part of the Services, servers, or networks connected to the Services
• Transmit any unsolicited or unauthorised advertising or promotional material
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Upload, transmit, or distribute any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Interfere with or disrupt the integrity or performance of the Services or the data contained therein
• Use automated means, including bots, scrapers, or crawlers, to access or collect data from the Services
• Circumvent, disable, or otherwise interfere with security-related features of the Services

5. Intellectual Property

5.1 Ownership

All content, materials, features, and functionality available through the Services, including but not limited to text, graphics, logos, images, audio, video, data compilations, and software, are the exclusive property of Bycezae or its licensors and are protected by applicable intellectual property laws.

5.2 Limited Licence

Subject to your compliance with these terms, Bycezae grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for their intended purpose. This licence does not include the right to sublicense, modify, adapt, translate, reverse engineer, or create derivative works based on the Services or any content therein.

5.3 User-Submitted Content

If you submit, post, or otherwise make available any content through the Services, you grant Bycezae a worldwide, royalty-free, non-exclusive licence to use, reproduce, modify, adapt, publish, and display such content in connection with operating and improving the Services. You represent that you own or have the necessary rights to grant this licence.

6. Payments and Subscriptions

6.1 Fees

Certain Services may require payment of fees. All fees are stated at the time of purchase and are subject to change with reasonable prior notice. You are responsible for all applicable taxes unless otherwise stated.

6.2 Billing

By providing payment information, you authorise Bycezae or its payment processors to charge the applicable fees to your designated payment method. You agree to keep your billing information current and accurate.

6.3 Refunds

Refund eligibility is determined on a case-by-case basis in accordance with our refund policy communicated at the point of purchase. Bycezae reserves the right to decline refund requests that do not meet the stated criteria.

6.4 Subscription Cancellation

You may cancel a subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period. Bycezae does not provide prorated refunds for unused portions of a subscription period unless required by applicable law.

7. Third-Party Links and Services

The Services may contain links to third-party websites, tools, or services that are not owned or controlled by Bycezae. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services. We encourage you to review the terms and privacy policies of any third-party services you access.

8. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. Bycezae expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components, or that any defects will be corrected.

The educational content available through the Services is provided for informational purposes only. Bycezae makes no representations or warranties regarding the accuracy, completeness, or suitability of any content for any particular purpose.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Bycezae and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Services.

In no event shall the total liability of Bycezae to you for all claims arising out of or relating to the use of the Services exceed the amount paid by you to Bycezae in the twelve months preceding the event giving rise to the claim, or one hundred euros if no such payment has been made.

10. Indemnification

You agree to defend, indemnify, and hold harmless Bycezae and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these terms or your use of the Services, including but not limited to any content you submit or transmit through the Services.

11. Privacy

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these terms by reference. By using the Services, you consent to the collection and use of your information as described in our Privacy Policy.

12. Modifications to the Services

Bycezae reserves the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

13. Modifications to These Terms

We may revise these Terms of Use from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you by email or through the Services. Your continued use of the Services after any such changes constitutes your acceptance of the revised terms. If you do not agree to the updated terms, you must stop using the Services.

14. Governing Principles

These terms shall be interpreted in accordance with generally accepted principles of international commercial law. Any disputes arising out of or in connection with these terms shall be resolved through good-faith negotiation in the first instance. Where resolution cannot be reached informally, disputes shall be submitted to binding arbitration under internationally recognised arbitration rules, unless otherwise required by applicable mandatory law in your jurisdiction.

15. Severability

If any provision of these terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms of Use, together with the Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Bycezae with respect to your use of the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
